From September 2015 all family court judges in England will be able to order DNA tests to determine a child’s parentage which will be paid for by CAFCASS (Children and Family Court Advisory and Support Service).

Government cuts in 2013 meant legal aid was no longer available for DNA tests so court cases were taking that much longer because parents couldn’t afford to pay for the tests. From September, CAFCASS will pay for them.

Where parents can resolve disputes regarding parentage out of court, they will need to make arrangements to do the DNA test themselves and will pay for the test themselves too. However, in those cases where this is not possible and court proceedings are issued, the judge will be able to order DNA tests which will not only help avoid the current court delays but will also assist the proceedings being conducted in a civilised way so that children do not suffer.
